An Oak Harbor man who was a Navy veteran, the father of two young boys and a talented lyricist recently died from injuries sustained in a collision with an impaired driver that occurred five months ago, according to court documents.
Marc Davis’ brother, Mitchell Davis, said his brother will be remembered as a loving man with a heart of gold.
“He was just one of those dudes who would stop and help a stranger,” he said. “He was loved by everybody who knew him.”
Mitchell Davis started a Gofundme account to help with the costs of the funeral. It can be found at www.gofundme.com/f/nzyrp-marc-davis.
Marc Davis passed away at a Seattle hospital on Aug. 27 after spending months in a coma, according to his brother. He was 40 years old.
Westyn Sillavan, the man accused of causing the March 30 collision, is now facing a vehicular homicide charge. Prosecutors originally charged the Oak Harbor man in Island County Superior Court with vehicular assault but amended the charge after Marc Davis passed away.
If convicted of the charge, Sillavan could face up to 10 years and five months in prison under the standard sentencing range.
Just after 11 p.m. March 30, Sillavan was driving north on Highway 20 near Sleeper Road in a Ford Explorer when he crossed the centerline, colliding with an oncoming Cadillac ATS driven by Davis, according to a Washington State Patrol report.
Davis was unconscious at the scene and suffered a traumatic brain injury. He was taken from the scene in an ambulance and then immediately airlifted to Harborview Medical Center in Seattle for treatment.
Sillavan was walking around when the trooper arrived. He said he had fallen asleep after driving a friend home and stopping for food at McDonald’s, the trooper wrote.
The trooper noted an odor of intoxicants coming from Sillavan, who initially denied drinking alcohol but said he had smoked marijuana. When asked to do a voluntary Breathalyzer test, Sillavan admitted to consuming whiskey about an hour before the crash, the trooper’s report states. The test showed a blood-alcohol level of 0.115, which is over the legal limit of 0.08, according to the report.
Mitchell Davis said his brother seemed to be improving at the hospital but then took an unexpected turn for the worse.
According to a supplemental report by a detective with the State Patrol, Marc Davis was “essentially in a vegetative state” when he passed away. The medical examiner ruled that his cause of death was medical complications resulting from the traffic accident.
Mitchell Davis said he and his brother grew up in Louisiana together and had a very strong bond. Marc Davis enlisted in the Navy and was stationed on Whidbey Island, where he decided to stay after being discharged. He worked construction and different jobs in the community. He had two boys, ages 6 and 10.
Marc Davis was also talented freestyle rapper who posted recordings on social media. His brother recalls that he would spend hours on the beach and other places, creating his videos. He called himself “Superpimp.”
