A Langley man accused of domestic abuse refused to speak with a deputy about the allegations because of her gender, court documents state.

Prosecutors charged Franklin Smith, 46, in Island County Superior Court on March 6 with felony harassment, malicious mischief and two counts of fourth-degree assault. The assault and malicious mischief charges were filed as domestic violence-related counts.

On March 3, the alleged victim went to the South Precinct of the Island County Sheriff’s Office and asked Sgt. Laura Price about getting a protection order against Smith, who is her estranged husband.

The woman said she and Smith were separated, but he entered her home. She claimed that Smith had assaulted her previously, according to the report.

The woman invited a former neighbor over to her home for a meeting related to her business. She became alarmed when she saw Smith drive up while the man was there; she asked him to leave through the back door, the report states.

Smith allegedly walked into the house and started calling the woman names. He grabbed her hand and hurt it, then pulled off her glasses and broke them; he jumped over a counter and screamed in her face, the report states.

Smith also confronted the man as he was leaving.

According to Price’s report, the man claimed that Smith put his hands on a large Buck knife and threatened, “I’ll kill you. I’ll get my friends to kill you!”

Deputies went to Smith’s home and took him into custody. They told Price that Smith refused to talk to her about the case because she’s female, Price wrote.
