The Langley City Council will discuss city attorney Mike Kenyon’s guidance on a draft inclusive city ordinance at its regular monthly meeting at 5:30 p.m. on Monday at city hall.

The guidance includes Kenyon’s advice on “city policy with respect to immigration enforcement, equal protection and equal provision of city services regardless of immigration status,” according to the city council’s agenda.

The document is not, however, available to the public; it is exempt from disclosure under the attorney-client privilege statute of RCW. 5.60.060.

The council can vote to waive the attorney-client privilege for its release to the public. Mayor Tim Callison said copies of the guidance will be available should the council decide to waive the privilege.

City councilwoman Dominique Emerson said she plans to ask the council to make the document public.

A first reading of the inclusive city ordinance drafted by Kenyon’s firm, Issaquah-based Kenyon Disend, is not on the agenda. But, Callison said the council “can ask to change the agenda or bring a motion from the floor for a first reading.”
